On September 16, 2022, US President Joe Biden issued an executive order suspending the US Department of Commerce's final rules for imposing new anti-evasion taxes on photovoltaic cells and photovoltaic modules imported from Cambodia, Malaysia, Thailand and Vietnam for a period of two years. The decision comes in response to strong opposition to the tax from US importers of photovoltaic modules, who have expressed concern and said investigations by the US Commerce Department have stalled the development process of many photovoltaic projects.
The two-year ban is President Biden's response to the U.S. Department of Commerce's decision to initiate a circumvention investigation on April 1, 2022, following a complaint filed by Auxin Solar, a U.S. photovoltaic module manufacturer. Auxin Solar claims that photovoltaic products produced in these Southeast Asian countries are not affected by anti-dumping and countervailing duty orders against Chinese photovoltaic cells and modules.
Circumvention cases, and potentially high tariffs on Southeast Asian countries, have effectively halted the development of many photovoltaic projects in the United States, leading President Biden to take the unprecedented step of invoking the National Defense Production Act to stop anti-circumvention investigations. The Defense Production Act also gives President Biden greater authority to empower U.S. industrial manufacturers to increase their capacity to manufacture photovoltaic modules domestically.
The provisions of the law adopted allow the president to issue an executive order suspending certain import tariffs in response to an emergency "due to the state of war or otherwise." During a state of emergency, the president may approve tax exemptions for the import of "food, clothing and medical, surgical and other supplies for emergency relief efforts." Although the suspension is for two years, the Commerce Department said its investigation would continue during that period, but if circumvention was confirmed, duties or cash deposits would not be imposed until after the two-year suspension had expired. President Biden's use of the Defense Production Act to block the Commerce Department from imposing additional tariffs is likely to face multiple challenges, but it is too early to say whether there will be an appeal. The current deadline for a preliminary ruling on the circumvention investigation is November 28, 2022.
The final rule made certain changes to the originally proposed rules, most importantly outlining that the two-year suspension of tariffs should not be used as a mechanism for PV developers to procure and hoard PV cells and PV modules in order to avoid possible tariffs. President Biden's declaration of a state of emergency on June 6, 2022, invoking provisions of the Tariff Act and the National Defense Production Act implemented in 1930, did not initially address concerns related to PV module inventories, but after reviewing comments from several industry groups representing domestic manufacturers and members of the Senate Finance Committee, The final rule, published on September 16, 2022, addressed these concerns. In its final rule, the U.S. Department of Commerce noted that "it is not the goal of the U.S. Department of Commerce to have photovoltaic products that enter the U.S. market prior to the termination date used in installed PV projects on a long-term basis, as the emergency declared by President Biden affects the measures we have taken." Taking all the comments into account, the Commerce Department made several revisions to the rule, including a provision limiting the tariff exemption to photovoltaic modules and photovoltaic cells "used or installed" in the United States within 180 days of the rule's termination date, which is no later than June 6, 2024.
