On December 18, the website of the European Parliament reported that the European Parliament and EU governments reached an agreement on the reform of the EU Emissions Trading System (EU ETS), and further disclosed the details of the carbon tariff bill. It confirmed that the carbon border adjustment mechanism (CBAM, also known as "carbon tariff") will be officially imposed from 2026. This is a year earlier than the first reading adopted in June.

The agreement also sets a timetable for cutting free quotas for EU companies, starting in 2026 and phasing them out altogether by 2034. To put this in context, the free quota for these sectors will be abolished by 2.5% in 2026, 5% in 2027, 10% in 2028, 22.5% in 2029, 48.5% in 2030, 61% in 2031, 73.5% in 2032, 86% in 2033, Eliminate 100% in 2034.

In addition, the agreement will cut combined emissions from sectors covered by Europe's emissions-trading system by 62% by 2030 compared with the 2005 plan, one percentage point more than the commission proposed. To achieve this reduction, the number of allowances across the EU will be reduced by a one-off 90 million tonnes of CO2 equivalent in 2024 and 27 million tonnes in 2026, 4.3 per cent per year from 2024-2027 and 4.4 per cent per year from 2028-2030.

Earlier this week, the European Parliament and EU governments agreed some of the details of CBAM, including the timing of the trial, what will be covered and how much emissions will be emitted. According to the agreement, the trial operation of CBAM will begin in October 2023 and will last until the end of 2025, 10 months later than the previous law. The agreement stresses that companies affected during the transition will only have to meet reporting obligations, aimed at collecting data.

In addition to steel, cement, aluminium, fertilisers and power, the latest agreement also identifies hydrogen energy, indirect emissions under certain conditions, specific precursors and certain downstream products, such as steel-like products such as screws and bolts, in the scope of application of CBAM.

Before the end of the transition period - that is, by 2026 - the commission should assess whether to extend the scope to other goods at risk of carbon leakage, including organic chemicals and polymers, with the aim of including all goods covered by the ETS by 2030, the parliament said. In addition, the Commission should assess methods for indirect emissions and the possibility of including more downstream products.
